Birth injuries (cerebral palsy, Erb's palsy) and surgical errors resulting in permanent disability produce the highest settlements — often $1M–$10M+. Misdiagnosis cases resulting in delayed cancer treatment or disease progression typically settle for $500,000–$3M. Medication errors and anesthesia mistakes vary widely based on resulting harm.

State Damage Caps

Many states cap non-economic damages (pain and suffering) in medical malpractice cases. California caps non-economic damages at $350,000 (recently increased from $250,000); Texas caps them at $250,000 per defendant. These caps can significantly limit recovery even in severe cases.
